There really needs to be a license to have children.

(CNN) -- A Pennsylvania man played an audiocassette to his sleeping stepson to induce the boy to kill his half-brother, prosecutors say.

At a preliminary hearing Wednesday, District Justice James Ellis ordered Donald Jerome Winniewicz of Chartiers, Pennsylvania, to stand trial on charges of solicitation to commit homicide, endangering the welfare of the minor, and corrupting the morals of a minor.

But the case may center on a child-custody dispute, and both prosecutors and defense attorneys have suggested the case might be settled before going to trial.

Chartiers Police Chief James Horvath said Winniewicz, 36, admitted to police that he made the 45-minute audiotape.

Horvath said the tape is made up of several segments and each features 30 to 50 whispered suggestions to kill the defendant's 4-year-old biological son.

"This more or less redefines the term bedtime story," Horvath said.

Police and Washington County District Attorney John Pettit said they are still investigating the case and the possibility that there is a custody battle involved.

Pettit said Winniewicz wanted his 10-year-old stepson to appear mentally unstable so he would not be able to visit his paternal grandparents, with whom there was a family dispute.

Police began investigating the case January 12 when Winniewicz's wife found the audiotape, Horvath said.

She has been granted a protection-from-abuse order preventing Winniewicz from seeing her or her children, Horvath said.

Defense attorney Michael DeRiso said the case against his client is weak.

Although his client admitted making the tape, "if he played it while he was sleeping, it is not a solicitation," DeRiso said. "The tape itself is not illegal to play."

"He was offering to play the tape that the [10-year-old] would hear, then the kid would say he was having crazy thoughts and would kill [his half-brother]. Then they would take the kid away from his grandparents," DeRiso added.

The tape "describes two ways to kill, the first is by putting a pillow on [the 4-year-old's] face, the second is by choking him," DeRiso said.

The district attorney hinted that due to the complications of the custody issue, the case might not be prosecuted fully.

"There may be ways to resolve this to the best interest of the children, the mother-wife and even the defendant," Pettit said.

Winniewicz was released from the Washington County Correctional Facility this week after posting $50,000 bond.

DeRiso said he plans to file motions to dismiss the case.

That is one messed up guy. I can't believe people like this are allowed to have children. Not that there's anyway to figure out if every person is messed up in the head prior, but geeze...

You see this is what happens when you don't have enough abortion and eugenics in the world. You get people who do things like this.

I hear Sudden Infant Death Syndrome can strike a person up to the age of 65, though. *cough* :whistle:

This is the newest case here in Ohio. You are right, people need a license to have kids.

At the time of that toddler's death, he weighed a pound less than Samara did at birth. At 1, she is a bit over 25 lbs. There is no excuse for something like this to happen.

We have the brainwashed cult mother who starved her toddler to death because god told her to breast feed him...and she stopped producing milk.

We were talking about cruelty, right?

There will always be cases that are extreme such as these. As someone whom has worked with Childrens Protective Services (CPS) first hand, there area multiplicity of ways that neglect can manifest itself - and you'd be surprised I'd imagine, the ways in which it can. From psychological to physical... some people just aren't capable of handling raising a child. Luckily, this tends to be more the exception, than the rule.
 
I thought that the whole tape playing bit while your asleep was a joke. I have never heard of it working. I would grow up to hate my father if I was that 4 year old.


Well I say he deserves a long long jail sentence.

These sorts of stories make me die a little more inside. It's too bad that in cases like this, the judge can't just make up his own mind what to do and say something like:
"Defense, shut up. Case closed. Your clients presence here on Earth is no good to those who wish to live in peace, so he goes to jail forever, no ifs, ands, or buts. No bail, no appeal, see ya later, I'm off to play golf, don't call me I'll call you, and you're disbarred for defending such excreta."

Ever heard of that lady...she got arrested for shoplifting(or some other crime) and got taken to jail w/out tellin the police she had a 4 yr old at home waiting for her...

The father, who doesnt live w/ her finally visited the lady and went /w the police to the apartment... they found the kid naked and alive...she had survived on ketchup packets and crackers for 5 days

Then there are the run of the mill losers...my friend's sister, who goes on crack binges and leaves her son at a babysitter who routinely forgets to feed him or change him. One day, the babysitter decided to take a nap and woke up to find the baby gone. He was picked up wandering along a major highway. Kid is two years old. Just great.
