I'm having trouble with my merc and I don't know what to do. I'm starting fresh with an MF blizz sorc and I got rushed to baal and did baal runs to 45 (where I am now). My act 2 defiance merc is sitting at level 16. Should I just suffer and level him up somewhere or what should I do? I don't know. >.>

Take off the equipment, and buy a new one at a higher level, you won't be at any disadvantage for buying a high level mercenary

The mercs available in hell have the same auras as those available in Normal, but they have slightly lower stats.

If you have to hire a new merc again, later, don't get it in Hell.
