Its little surprise to be reading this garbage from people unwilling to even divulge the city from where they come from. You get bad cops with the good ones, the vast majority are good here in Aus and the bad ones often get rooted out by IA. When it comes to shredding data then its more amazing that people who know its uses don't encourage it's use unless you want people to have their CD Keys, Serial numbers and other very important information stolen. Its seriously in bad taste in any which way you look at it to see any humour in people losing such important personal property no matter where you come from. There is nothing suspicious about protecting your privacy!

It has absolutely nothing to do with whether its a bad cop or a good one. It has everything to do with perception.

It also has to do with the fact that there is no need to turn over information to someone who doesn't need to know it.

If the police come knocking on your door about a piracy related crime, I imagine the physical presence of the files or lack thereof is superfluous.

It depends on other evidence they have.

I know there was a file sharing site that got shut down, but when the police confiscated the servers they turned off the machines and the data they need is now encrypted and they are unable to prosecute the site owners without the evidence (this was in the UK).

There was also a case where a (IIRC) border patrol cop asked to see the contents of a guys laptop and found some child porn on it (this was in the US). He then turned the laptop off without realizing the hard disk was encrypted with a program (Pretty Good Privacy IIRC). The guy used his right not to give evidence that might incriminate himself to avoid having to give the prosecution the passwords.

FYI, I believe it was determined that turning over the encryption key did not violate the 5th Amendment because the cops had a warrant.

Even if they do have a warrant he guy faces 20 years in prison and to become a registered sex offender if they get into the computer. What kind of punishment does he face if he doesn't reveal the password?
