    I don't know if we put our journal online. It might make it on Westlaw/Lexis, but there's no general access to that. It's not a fancy journal - it's I/S: A Journal of Law and Policy in the Information Society if you're interested in finding it.

    Two such events in two days?

    And neither one involving using the internet to use credit cards.

    Not on the scale of these two breaches I hope.

    For the last at least 8 years I've been saying that we need much much tougher laws regarding information security.

    We need laws regarding quick responses and how to deal with data breaches. There's not much we can do to prevent the actual breaches though. :(

    Not accidental breaches but I think there should be definite laws against even minor personal breaches. Such as looking up non-public info for personal reasons.

    But those are so hard to prove. And pretty rare. There's already tough laws against invading someone's privacy, and those are much easier to write, since they are criminal statutes. It's the accidental ones that potentially expose millions of people that sucks.

    Seems to me that there are laws in place with respect to protecting private information that has been placed in your care. As mentioned though, that still leaves the possibility of breaches. Who determines what is reasonable measures to have in place?

    Just because these cases were announced close together doesn't mean that the breaches happened close to one another. The radio reported on the way home that the Winners breach happened (initially) as long ago as 2003.

    Makes you feel all warm and fuzzy, eh?

    For now, it's state governments. There have been a variety of bills proposed in US Congress, but none of them have gone through. Partisan politics really sucks when you're trying to protect your constituents. I'm not really sure how Canadian law deals with it though. I'd imagine it's similar to some of the state law in the US.

    In large part because the way the system was created, the federal government was never intended to have the degree of involvement they do in our day to day lives--that power was left to the smaller and more agile state legislatures. Didn't quite work out that way though.

    AFAIK at least in theory the US federal government only has powers tht have been given to it by the constitution. In Canada the provinces only have power that the Feds have given them.

    Pretty sure that sums it up. Feds pass down the stuff they think should be handled locally, and no matter who deals with it, us people at the bottom rung can't do anything to change it.
